The volume collects several contributions, many of which were presented during a two-year-long cycle of meetings on comparative law, held at the University of Florence and organized by the curator with the aim of suggesting a critical and interdisciplinary vision for the theme of family mediation. First, the topic of 'lenient justice' is addressed, thanks to a series of essays dedicated to the philosophical, psychological and educational perspectives, as well as to the legal profiles of the subject. The volume also analyses the experiences of the main common law and civil law systems, of which an extensive study carried out by several international experts is provided. After that, a set of issues which are currently at the centre of heated debates are examined, as they relate to the coexistence of traditional and innovative models in the context of family relationships. Finally, attention is paid to a reflection whose focus are the guarantees to prepare in order to protect the subjects involved in the conflict, not only within the family, but also in the broader educational and social context.
Il volume raccoglie diversi contributi, molti dei quali presentati in occasione di un ciclo biennale di incontri comparatistici, svoltisi presso l’Università degli Studi di Firenze ed organizzati dalla curatrice, con l’intento di proporre una visione critica ed interdisciplinare del tema della mediazione familiare. Dapprima, si affronta il tema della ‘giustizia mite’, grazie a una serie di saggi dedicati alla prospettiva filosofica, psicologica e formativa, nonché ai profili giuridici della materia. Si analizzano, inoltre, le esperienze dei principali ordinamenti di common law e di civil law, di cui si fornisce un esteso approfondimento, compiuto da vari esperti stranieri. Si prende in esame, quindi, un insieme di questioni attualmente oggetto di un acceso diabattito, in quanto correlate alla compresenza di modelli tradizionali ed innovativi, nell’ambito delle relazioni familiari. Infine, si dà spazio ad una riflessione incentrata sulle garanzie da apprestare a tutela dei soggetti coinvolti nel conflitto, non solo all’interno della famiglia, ma anche nel più ampio contesto educativo e sociale.
