Our constitutional legislation lends itself to a rather differentiated judgement, both in terms of performance and actuality, depending on whether one refers, respectively, to the part concerning the form of State intended as a set of purposes and inspiring values of the action of the public authorities, and as a way of posing relations between the latter and the community, to the part concerning the organization and functioning of public state powers, or to the part concerning the form of State intended as the way in which the relations between the State and the decentralized authorities are established. Moreover, the judgement on the performance and topicality of the legislation relating to the first of the afore-mentioned parts is particularly relevant for the purposes of assessing the performance and topicality of the constitutional regulations as a whole.

La nostra normativa costituzionale si presta, sia sotto il profilo del rendimento che sotto quello dell’attualità, ad un giudizio piuttosto differenziato a seconda che si tratti, rispettivamente, della parte concernente la forma di Stato intesa come insieme delle finalità e dei valori ispiratori dell’azione dei pubblici poteri e come modo di atteggiarsi dei rapporti fra questi ultimi e la comunità, della parte concernente l’organizzazione ed il funzionamento dei pubblici poteri statuali e della parte concernente la forma di Stato intesa come modo atteggiarsi dei rapporti fra Stato ed enti decentrati. Peraltro, il giudizio sul rendimento e sull’attualità della normativa attinente alla prima delle parti in questione risulta particolarmente rilevante ai fini della valutazione del rendimento e dell’attualità della normativa costituzionale complessivamente considerata.
